Background

Under the authority of Section 104 of the Comprehensive Environmental Response, Compensation, and Liability Act (CERCLA) or Superfund of 1980, as amended; Section 311 of the Clean Water Act (CWA), as amended by the Oil Pollution Act (OPA) of 1990; Subtitle I of the Resource Conservation and Recovery Act (RCRA) and pursuant to the National Oil and Hazardous Substances Pollution Contingency Plan (NCP) (40 CFR Part 300); Presidential Decision Document (PDD) # 39; the Robert T. Stafford Natural Disaster Act and pursuant to the National Response Framework (NRF) and in accordance with any reauthorizations or amendments to any of the above named statutes and/or new response legislation, the Environmental Protection Agency (EPA) has been delegated the responsibility to undertake assessments and response actions with respect to the discharge/release or threat of discharge/release of oil, petroleum products, hazardous substances, or pollutants and/or contaminants, that pose an actual or potential threat to human health or welfare, or to the environment.

In addition, the EPA has the obligation pursuant to Emergency Support Functions (e.g., ESF #10) under the NRF and pursuant to other laws to help and/or mitigate endangerment of the public health, welfare, or environment during emergencies or natural disasters and to support states and communities in preparing for responses to releases of oil, petroleum products, and hazardous substances and to provide response and removal services in response to incidents involving acts of terrorism, nuclear, biological and/or chemical incidents, and federally-declared disaster incidents.

Requirements

  • The purpose of this contract is to provide response services for emergency actions, time-critical removal response actions, non-time-critical removal response actions, and early remedial actions, including drills and exercises simulating emergency actions, taken pursuant to any of the authorities cited above to Federal officials responsible for the activities described in the background for EPA Region III (Delaware, Maryland, Pennsylvania, Virginia, West Virginia, and the District of Columbia)
  • A regional cross-over, a response in another EPA region, may also be requested under this contract
  • The Contractor shall take any actions required to mitigate or eliminate any hazard or damage to the environment resulting from, or drills and exercises simulating and preparedness activities for, the following:
    • A discharge/release or threat of a discharge/release of oil, petroleum products, hazardous substances, pollutants, or contaminants into the environment
    • A discharge/release or threat of a discharge/release of oil, petroleum products, hazardous substances, pollutants or contaminants involving terrorist acts
    • natural disasters during a Presidential disaster declaration
  • The Contractor shall accomplish all off-site storage, transportation, treatment, and disposal of oil, petroleum products, hazardous substances, pollutants or contaminants, including contaminated media, in accordance with and meeting all applicable safety and health laws and regulations at the Federal, state, and local level
  • The technical requirements of this contract are performed during response actions conducted on either an emergency, time-critical, or non-time-critical basis. Examples of technical requirements conducted during response operations under this contract follow this generic list
    • Project planning and support
    • Containment and countermeasures
    • Decontamination and response mitigation
    • Treatment and Transportation and Disposal (T&D) operations
    • Restoration and soils stabilization
    • Analytical support services
    • Demolition and/or dismantlement services
    • Construction and/or installation of structures, equipment, or other appurtenances related to, or in support of a removal action
    • Marine operations
