The State currently maintains a statewide Commercial Off-the-Shelf (COTS) Software Master Contract awarded in 2012 (“COTS 2012”).

In anticipation of its expiration, DGS is conducting market research to inform development of a successor Master Contract that may include:

  • Functional Area I – COTS Software & Software as a Service (SaaS)
  • Functional Area II – Implementation & Training Services
  • Functional Area III – Maintenance & Support Services

Requirements

The following information is sourced from Request for Information (RFI) document and is subject to change upon the release of a formal solicitation.

Recommended Socioeconomic Participation Percentages

Provide recommended participation percentage ranges for:

  • Minority Business Enterprise (MBE)
  • Veteran-Owned Small Business Enterprise (VSBE)
  • Small Business Reserve (SBR), if applicable

Recommendations should be provided separately for:

  • Functional Area I
  • Functional Area II
  • Functional Area III

Respondents may recommend reduced or zero participation where commercially justified; however, detailed objective supporting rationale must be provided.

Indicate whether participation requirements should be established:

  • At the Master Contract level,
  • At the Task Order (PORFP) level,
  • Both, or
  • Not recommended.

Provide detailed explanation supporting your recommendation.

Subcontracting Opportunities For each Functional Area:

  • • Identify specific subcontracting opportunities
  • • Describe types of work reasonably sub-contractable
  • • Provide estimated percentage of total contract value that could realistically be subcontracted
  • • Identify structural, contractual, pricing, or commercial limitations affecting subcontracting

Special Considerations – Functional Area I (COTS & SaaS)

The State recognizes that certain licensing models may involve:

  • Manufacturer-direct sales
  • Publisher-controlled pricing
  • Enterprise agreements
  • Pass-through pricing
  • Non-divisible subscription structures

Respondents must clearly distinguish:

  • Licensing value vs. services value
  • Manufacturer-controlled vs. reseller-controlled transactions
  • Portions of work that may reasonably support subcontracting
  • Structural limitations that restrict subcontracting

If recommending reduced or zero participation under Functional Area I, detailed market-based justification is required.

Considerations – Functional Area III (Maintenance & Support)

Respondents must distinguish between:

  • Manufacturer-direct renewals
  • Embedded SaaS subscriptions
  • Reseller-provided maintenance
  • Value-added technical services

Provide commercially realistic subcontracting percentage estimates based on structure.
